The hearing will take place December 3.

Obama has lived in the US illegally since arriving from Kenya as a teenager for school.

His status as an illegal immigrant became public after he was arrested for drunken driving in Framingham, Massachusetts in 2011. He was ordered deportation in 1992 after he failed to renew an application to stay.

When he was arrested, Obama told police he would call the White House. 

After the arrest, a spokesperson for the president said he was not aware his uncle was in the US illegally and would not get involved on his behalf.

Obama’s lawyer, Scott Bratton hopes the hearing will allow his client to remain in the US.

“Everybody wants to stay in America”, he said.

Obama is the brother of the president’s aunt, Zeituni Onyango, who is an illegal migrant that won the right to stay in the US.

The president refers to his uncle as “Uncle Omar” in his memoir ‘Dreams From My Father’, and claims that he “left for America 25 years ago and had never come back”.

Onyango and Zeituni are children of the president’s grandfather Hussein Onyango Obama’s third wife, Sarah. The president’s father, Barack Senior, was born to his grandfather’s second wife, Akumu, but was primarily raised by Sarah.
