Last week Baden-Clay, 41, was refused bail on a charge of murdering his wife on April 19.
Police have revealed the Brisbane real estate agent sent a text message to his wife’s phone at 6.20am on April 20 saying: “Good morning! Hope you slept well? Where are you? … Love G”.
The police affidavit said at 6.41am Baden-Clay sent another text saying: “Al, getting concerned. Where are you? … I’m dressed and about to make lunches. Please just text me back or call! Love G”.
But Justice David Boddice said he considered Baden-Clay a flight risk but in an affidavit dated June 21, about a week after his arrest, Baden-Clay denied he was a flight or suicide risk.
“I’ve never considered it. I maintain my innocence and will be strenuously defending the charges,” he said.
“I note that no attempts of self harm have been made by me despite the intense media scrutiny, and the report of me as a person of interest as early as April 23, 2012.”
