A judge has ordered a 51-year-old Frenchman to pay his ex-wife £8500 in damages for not having sex with her enough.

The man was fined under a law which says that married couples must have "shared communal life", which the judge said implies "sexual relations must form part of a marriage".

The wife filed for divorce two years ago, citing the lack of sex as the reason for the break-up.

The ex-husband blamed "tiredness and health problems" for his lack of interest in the bedroom.

But a judge ordered that he pay 10,000 euros in compensation for the lack of sex.

The judge said: “A sexual relationship between husband and wife is the expression of affection they have for each other, and in this case it was absent.

“By getting married, couples agree to sharing their life and this clearly implies they will have sex with each other.”
